This End User License Agreement ("EULA") governs your use of the SplitWiz: Video Split Edit mobile application (referred to as "SplitWiz," "the App," "we," "us," or "our"). By downloading, installing, or using SplitWiz, you agree to be bound by the terms and conditions of this EULA. If you do not agree to these terms, you must not use SplitWiz.
a. Subject to the terms of this EULA, SplitWiz grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes. You may download, install, and use the App on your mobile device solely for the purpose of splitting, editing, saving, and sharing videos.
b. This license is conditioned upon your compliance with all of the terms and conditions of this EULA. Any violation of these terms may result in the immediate termination of your license without notice.
a. You may not copy, modify, distribute, sell, sublicense, lease, or transfer any part of SplitWiz or its content without prior written consent from SplitWiz.
b. You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of SplitWiz or any part thereof, except to the extent permitted by applicable law.
c. You may not use SplitWiz in any manner that could damage, disable, overburden, or impair the functionality of the App or interfere with any other party's use and enjoyment of SplitWiz.
a. SplitWiz retains all right, title, and interest in and to the App, including all intellectual property rights therein. The App is protected by copyright, trademark, and other laws of the United States and other countries.
b. You acknowledge and agree that SplitWiz owns all data generated by your use of the App, including any videos, edits, or other content created or modified using SplitWiz.
Your use of SplitWiz is subject to our Privacy Policy, which governs the collection, use, and disclosure of your information. By using SplitWiz, you consent to the collection and use of your data as described in the Privacy Policy.
a. SplitWiz may from time to time provide updates, upgrades, or patches to the App ("Updates"). These Updates may be necessary to continue using SplitWiz or to access new features and functionality. By downloading and installing Updates, you agree to be bound by the terms and conditions of this EULA.
b. SplitWiz may provide support services related to the App ("Support Services"). Any Support Services provided are subject to this EULA and may be terminated at any time without notice.
a. SplitWiz is provided "as is" and "as available" without any warranty of any kind, either express or implied. To the fullest extent permitted by applicable law, SplitWiz disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
b. SplitWiz does not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App or the server that makes it available are free of viruses or other harmful components.
a. In no event shall SplitWiz be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of SplitWiz.
b. SplitWiz's total liability to you for all claims arising out of or related to this EULA or your use of SplitWiz shall not exceed the amount paid by you, if any, for the App.
You agree to indemnify, defend, and hold harmless SplitWiz, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to your use of SplitWiz or any violation of this EULA.
This EULA shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
If any provision of this EULA is held to be invalid, illegal, or unenforceable, the validity, legality, or enforceability of the remaining provisions shall not in any way be affected or impaired.
SplitWiz reserves the right to update or modify this EULA at any time without notice. Your continued use of SplitWiz after the effective date of any changes constitutes your acceptance of the revised EULA.
